1. Introduction

These Terms of Use govern access to and use of the website mb-zi.eu and its subdomains (“Website”), operated by Lumanaj d.o.o., Razgled 33, SI-6330 Piran, Slovenia (“Operator”).

The Website provides information and services related to the promotion and sale of Zepter products. Please note that all purchase contracts are concluded directly with Zepter International Poland Sp. z o.o. (“Zepter”), ul. Domaniewska 37, 02-672 Warsaw, Poland, which is the seller and contractual party.

By using this Website, you agree to these Terms of Use.

2. Definitions

  • Operator – Lumanaj d.o.o., as the owner and operator of the Website.

  • Zepter – Zepter International Poland Sp. z o.o., as the seller of products.

  • Website – mb-zi.eu and its subdomains.

  • User – any legal or natural person accessing or using the Website.

  • Consumer – a natural person acting outside their trade or profession, entitled to consumer rights under EU law.

  • Services – all functionalities made available on the Website, free of charge.

  • Content – all texts, graphics, images, logos, multimedia, and other materials published on the Website.

3. Use of Services

  • The Website may be used without registration.

  • Users are responsible for providing accurate and lawful data.

  • Submitting personal data of third parties or attaching identity documents is strictly prohibited.

4. Intellectual Property

  • The Website, its domain, subdomains, and Content are protected by intellectual property rights owned by the Operator or Zepter.

  • Content may be used only for personal purposes. Commercial use, copying of databases, or automated data extraction is prohibited without prior written consent.

  • If Users upload content (e.g., logos, text), they grant the Operator a non-exclusive, territorially unlimited license for the duration of the contractual relationship.

5. Payments

  • All payments for products ordered via the Website are made directly to Zepter International Poland Sp. z o.o..

  • Orders are payable 100% in advance by bank transfer to Zepter’s designated bank account.

  • Lumanaj d.o.o. is not authorized to accept payments in cash or through its own accounts.

  • Products are shipped only after full payment has been received by Zepter.

  • Any transfer fees or related costs are borne by the Customer.

6. Deliveries

  • Deliveries are available only to Austria, Germany, and Spain.

  • Please note: BIOPTRON products are not delivered in Spain.

  • Delivery times depend on product availability and destination. Estimated times will be communicated by Zepter at the order confirmation stage.

  • Lumanaj d.o.o. is not responsible for logistics, shipping, or delivery delays.

7. Warranty

  • All products purchased are covered by a legal warranty against material and workmanship defects, provided directly by Zepter.

  • Warranty claims must be submitted to Zepter. Claims received by Lumanaj d.o.o. will be forwarded to Zepter without delay.

  • After warranty expiration, Zepter may offer paid repair services with a new 12-month warranty for each repair performed.

  • Consumers’ statutory rights under applicable law remain unaffected.

8. Right of Withdrawal (Returns & Refunds)

  • Consumers have the right to withdraw from a purchase contract within 14 days without giving any reason, in accordance with EU consumer law.

  • The withdrawal period expires 14 days from the day the consumer receives the goods.

  • To exercise the right of withdrawal, the consumer must notify Zepter of their decision to withdraw.

  • Lumanaj d.o.o. may assist by forwarding withdrawal requests to Zepter.

  • Refunds, returns, and related processes are handled directly by Zepter.

9. Complaints

  • All product-related complaints must be addressed to Zepter, as the seller.

  • Complaints submitted to Lumanaj d.o.o. will be forwarded to Zepter immediately.

  • Users may contact Lumanaj at info@mb-zi.eu for support or forwarding assistance.

10. Medical Disclaimer

  • Information provided on the Website regarding BIOPTRON or other products is for informational and promotional purposes only.

  • It is not intended as medical advice, diagnosis, or treatment.

  • Customers should consult a qualified healthcare professional before using medical devices for any health-related purpose.

11. Limitation of Liability

  • The Operator is not liable for the sales process, payments, deliveries, warranty obligations, or refunds, as these are the sole responsibility of Zepter.

  • The Operator is not responsible for technical malfunctions, temporary unavailability of the Website, or damages caused by incorrect data entered by Users.

12. Changes to Terms

The Operator may amend these Terms. Updated Terms will be published on the Website and become effective upon publication. Existing Users will be notified on mb-zi.eu at least 15 days before changes take effect. Continued use of the Website constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

  • These Terms of Use (regarding Website access and use) are governed by the laws of the Republic of Slovenia.

  • Disputes will first be resolved amicably; if not possible, jurisdiction lies with the competent court in Koper, Slovenia.

  • Purchase contracts concluded with Zepter are governed by Polish law, under the jurisdiction of Polish courts.
